Good news. The sec­ond cir­cuit court has said that even if a provider records tele­vi­sion for you in the cloud based on your choices, and then lets you play it back by stream­ing it, it is still just time-shifting, and is fair use.

This is one of the some­what no-brainer solu­tions for tele­vi­sion, that are much much eas­ier than a lot of the cur­rently uti­lized sys­tems, but that never could be done because of the chill­ing effect of copy­right fear.

Watch­ing my par­ents use at&t’s u-verse is sad to me. The video qual­ity is not great, and when some­one runs 3 min­utes over, as with tivo, you’ve missed it. If your cable goes out for 1 minute in the mid­dle of a show, that ruins your copy. There is no rea­son for this. We can trans­mit files across a net­work at 100% reli­a­bil­ity. This weird sce­nario where every­one tries to mimic the VCR because that is the only solu­tion that has been court tested is finally over hopefully.
